Directors Responsibilities for Health & Safety

After the following incidents took place;

Heavy Goods Vehicle ploughs into queue of people at bus stop, number of fatalities reported, driver found to be over the drink drive limit.

Warehouse operative drives forklift truck into racking causing it to collapse killing another operative.
Investigations reveal forklift driver under the influence of drugs.

Office worker attacks fellow workers tow on critical list one dies at scene. Attacker found to be under the influence of alcohol and drugs.

These are of course fictitious headlines but it is not beyond the realms of possibility over the next few months that Company Directors and Health & Safety managers will find themselves facing Corporate Manslaughter charges resulting in, not just an hefty fine, but imprisonment for those deemed responsible.

Remember Ignorance of these issues is no defence against charges of this magnitude.

Can Companies be sure that when the drivers leave their depots early in the morning they are not still under the influence of Alcohol or Drugs from the night before, or that their employees operating machinery or working in the offices have not taken something during their dinner breaks or tea breaks.

They can never be 100% sure, but they can put procedures and testing in place which will ensure that as a company they are doing all that is reasonably practicable to ensure they are meeting their responsibilities.
